1. Your legal guarantees
For your online purchases, Beninese law (Digital Code) protects you with three guarantees, which are in addition to your right of withdrawal (see Returns and refunds). They are provided by the seller of the product.
The guarantee of conformity
The product must conform to your order: suitable for the usual use of a similar product, and consistent with the description and qualities presented by the seller, including in its advertising. The seller is liable for lack of conformity that exists at delivery.
- You report the lack of conformity to the seller within 15 working days of receiving the product, by registered letter with acknowledgment of receipt (an email to contact@koutonou.com allows us to forward it to the seller immediately).
- Defects that appear within 24 months of delivery are presumed to have existed at delivery, unless proven otherwise (6 months for a used product).
- You choose, at no cost : keep the product and obtain a refund of part of the price, return the product and be refunded the full price, or return the product and receive a product that conforms to your order.
- The claim is time-barred after 2 years from delivery.
The guarantee against hidden defects
The seller guarantees the product against hidden defects that make it unfit for its intended use, or that reduce that use so much that you would not have bought it, or would have paid less, had you known of them. The seller is liable even if they were unaware of the defects. You have 2 years from the discovery of the defect, with the same choices as for conformity.
The guarantee against eviction
The seller guarantees you against any eviction, that is, against the total or partial loss of the product or against encumbrances not declared at the time of sale.
2. Commercial warranties
A commercial warranty is a voluntary commitment by the seller or the manufacturer: for example, to repair, replace or refund a product that breaks down within a given period (6 months, 1 year, 2 years…). It is not mandatory and is in addition to your legal guarantees, which it can never reduce. The seller cannot use it against you to refuse a legal guarantee.
Where to find it
- On the product page : when the seller offers a commercial warranty, the “Commercial warranty” item in the features states its duration (3 months, 6 months, 1 year, 2 years…), and its description sets out the conditions. If this item is missing or says “No commercial warranty”, the product only has the legal guarantees.
- On the receipt or invoice : the law requires the seller to provide a document stating the technical characteristics of the item and a receipt showing the price and the duration of the warranty.
What the seller must state
- the duration of the warranty, its start date and its nature (repair, replacement, refund);
- what is covered and what is not, without contradicting the legal guarantees;
- who to contact and how (seller or manufacturer contact, documents to provide);
- this information in French, and compliance with its commitment.
3. Defective, damaged or non-conforming product: what to do
- Gather your proof of purchase (order confirmation, invoice or receipt), your order number and photos of the problem.
- Contact the seller from their page or your account, or write to us at contact@koutonou.com: we forward your request to the seller. The seller undertakes to reply within 48 working hours.
- No reply or no solution : Koutonou.com acts as mediator and follows your case with the seller.
- You choose the solution provided by law (partial refund, full refund upon return, or a conforming product), or the commercial warranty if it suits you better.
4. Product safety and recalls
Sellers may only offer products that comply with the law and the standards applicable in Benin, with the necessary safety information: hazards, instructions for use, warnings and, for a dangerous product, a manual in French. Dangerous or non-compliant, counterfeit, falsified, expired or toxic products are prohibited (see the Seller terms and conditions).
A product seems dangerous to you
- Stop using it.
- Report it to us with the link to the product page, your order number if you have one and, if possible, photos: see Report a seller or illegal content.
- In an emergency or in case of injury, contact the emergency services first.
Product recalls
No product recall is published at the moment; safety alerts and recalls will be published on this page. If a product you bought is recalled, the recall states what to do (repair, replacement or refund) and your legal guarantees remain applicable. Koutonou.com promptly informs the competent authorities of any illegal activity of which it becomes aware.
